Dispute Resolution

The chamber conducts commercial disputes from the first notice to the final appeal. On the original side that means suits and commercial suits before the Delhi High Court and the district courts, applications for interim relief, and the execution of decrees. On the arbitration side it means the proceedings the Arbitration and Conciliation Act, 1996 sends to court: the appointment of arbitrators under Section 11, interim measures under Sections 9 and 17, the termination of a tribunal's mandate under Section 14, challenges to awards under Section 34, and appeals under Section 37.

The matters arise from construction and infrastructure contracts, supply and distribution arrangements, shareholder and partnership disputes, property and co-operative housing society disputes, and the recovery of money. The chamber also acts in consumer proceedings before the National Consumer Disputes Redressal Commission and in mediation where the court refers a matter to it.

Procedure is treated as part of the merits. Questions of jurisdiction, limitation, the rejection of a plaint under Order VII Rule 11, and the scope of an interlocutory order are argued with the same care as the substantive case, because they often decide it.
