About
The Firm
A disputes chamber in Defence Colony, New Delhi.
Vertari Legal is a litigation chamber founded by Madhav Bhatia and Shreshth Arya and now conducted by four partners. It appears before the Supreme Court of India, the Delhi High Court and other High Courts, the district courts of Delhi, and the tribunals and authorities that hear tax, money-laundering, environmental, insolvency and service matters.
The chamber's practice is contentious. It advises on the position a client is in and the forum in which it is best tested, drafts the pleadings, and argues the matter through to the appellate court. Legal opinions are given where a client needs a considered view before a step is taken.
Preparation starts at the papers. Every brief is read in full before a line of argument is settled, and the argument is then built on the reported law. The chamber maintains its own research base, a bank of propositions extracted from the judgments it has relied on and indexed by statute, provision and subject, and its lawyers add to it as the matters are worked.
Clients include individuals, companies, co-operative societies, financial institutions and public-sector undertakings. Much of the work involves the State on the other side: a tax department, an investigating agency, a licensing authority or a government contracting party.
Method
How a matter is handled
- The record first
- The papers are read in full and a chronology is settled before the legal questions are framed.
- Forum and timing
- Which court, which remedy and in what order. It is decided at the advisory stage, because it shapes everything after.
- Argument from authority
- Every proposition put to a court is tied to the paragraph of the judgment that supports it.
- One team through the appeals
- The lawyers who prepare a matter at first instance carry it to the High Court and the Supreme Court.
